Digital Storefronts Define Trademark Jurisdiction, Rules Delhi HC

Rukhmani Keshwani v. Raju Agarbatti Works & Anr. , FAO (COMM) 99/2024 (Delhi High Court, Division Bench, decided 01.07.2026) Why This Case Matters For any business that sells through a website, a marketplace listing, or a platform like IndiaMart, Amazon, or Etsy, this ruling answers a question that keeps coming up in Indian IP litigation: can you be sued for trademark or copyright infringement in a city where you have no office, no warehouse, and no employee — simply because your goods are listed online and reachable there? The Delhi High Court's answer, reaffirming and extending its own recent line of authority, is yes — provided the online listing shows purposeful commercial targeting , not mere passive accessibility. Actual completed sales are not required. This has direct consequences for how foreign and domestic manufacturers, franchisors, and e-commerce sellers should think about litigation risk exposure across Indian jurisdictions. The Dispute in Brief R...

Jurisdictions

Jurisdictions Covered

One firm, one coordinated strategy, every jurisdiction.

Headquartered in New Delhi, near the Indian Patent Office, Aswal Associates coordinates patent, trademark, design, and copyright filings and enforcement across more than 50 countries through our trusted network of associate firms. Whether you need a single national filing or a globally coordinated portfolio strategy, we manage the process end to end.

India

Our home jurisdiction and core strength. We handle the complete lifecycle of IP rights before the Indian Patent Office, the Trade Marks Registry, and the Designs Office — from filing and prosecution to opposition, litigation, and enforcement before the Delhi High Court, the Supreme Court of India, and other specialised IP benches.

South Asia

We have provided regional IP coverage since 2008, with associates and affiliates across:

  • Bangladesh
  • Nepal
  • Bhutan
  • Maldives
  • Sri Lanka
  • Pakistan

We closely track evolving regional frameworks — for instance, the Maldives' upcoming national IP registration system through MIPO — to help clients time their filings strategically.

South East Asia & ASEAN

As there is no unified regional patent or trademark system in ASEAN, protection requires individual national filings. We coordinate this through our associate network across:

  • Singapore
  • Malaysia
  • Thailand
  • Vietnam
  • Indonesia
  • Philippines

For trademarks, several ASEAN jurisdictions accept Madrid Protocol applications, while others require direct national filing. For patents, we typically advise PCT national phase entry to preserve priority while assessing target markets.

East Asia

We coordinate filing and prosecution in:

  • China (CNIPA)
  • Japan (JPO)
  • South Korea

Europe & the United Kingdom

We assist clients in securing protection through the European Patent Office (EPO) and the EU Intellectual Property Office (EUIPO), as well as via the Unitary Patent system, which offers uniform protection across participating EU member states through a single registration and renewal — often at a meaningful cost saving compared to validating a European patent in multiple countries individually. We also handle UK filings.

United States

Filing, prosecution, and portfolio strategy before the United States Patent and Trademark Office (USPTO), with particular depth in pharmaceutical, biotechnology, and software-related inventions.

Other Jurisdictions

Through our associate network, we also support clients seeking protection in Australia and South Africa, and can coordinate filings in additional countries on request.

International Filing Systems We Use

  • PCT (Patent Cooperation Treaty) — a single international application preserving priority across contracting states for up to 30–31 months, before national phase entry.
  • Madrid Protocol — a single trademark application designating multiple member countries.
  • Hague System — centralised filing for industrial designs across member jurisdictions.
  • Paris Convention — priority filing rights across member countries within set timelines.

In the matter of  Makemytrip India Private Limited vs Booking.com B. V. & Ors. , vide its order dated 27th April 2022, Justice Pratibha M. Singh of Delhi High Court granted injunction in favour of Make My Trip (hereinafter “MMT”. MMT had filed the suit seeking protection of its registered trademarks 'MakeMyTrip' and its variants used by Booking.com B.V. as keywords on the Google Ads Program for promoting its services as advertisements when search results are displayed on the Google search engine . The contention of MMT was that when a search is carried out for 'MakeMyTrip' in the Google search bar, quite often the first advertisement which is displayed in the search results in the advertisement category is that of Booking.com, who is one of the major competitors of MMT. According to MMT, such use of its registered mark would constitute infringement, especially when done by its competitor such as booking.com.   Booking.com relied on the judgment of the E...

Trademark Registation in Myanmar

The Parliament of Myanmar has passed the Myanmar Trademark Law on January 30, 2019. Myanmar is making efforts to commence the new Trademark system by replacing the current practice of registration of Trademarks by registration of Deeds of Trademark Ownership Declaration with the Office of the Registration of Deeds.   The I ntellectual Property Office (IPO) of Myanmar will be established under the Ministry of Commerce of Myanmar. The trademark system will recognize existing trademark registrations, for that the IPO of Myanmar will commence a “soft-opening” period starting from January 2020 for these existing trademark registrations to be re-filed within six (06) months on a first-to-file principle.   Fresh Trademark Applications can only be filed after above period is over i.e. tentatively July 1, 2020. There is no bar to secure registration by earlier method till then and therefore it is possible to file new applications under the existing sys...
